Historic Sylvan Park sues Metro regarding overlay disapproval

Historic Sylvan Park has filed suit against Metro Government, arguing that the Metro Planning Commission's recent disapproval of a conservation overlay was illegal.

Of note, former councilman and ex-planning commissioner John Summers is aligned with Historic Sylvan Park and is a co-plaintiff in the suit. As a councilman representing the area in the late-1990s and early 2000s, Summers has long led the preservation fight in Sylvan Park, in which he still lives. The neighborhood group wants the overlay, feeling it will help preserve the character of the area.

At issue are about 700 Sylvan Park homes that would be put into the overlay, a zoning designation that would require owners of any home built before 1945 to seek approval before modification or demolition. Opponents argue the overlay would be excessively restrictive and place undue financial burdens upon them.
