Prepped to emerge from bankruptcy, Back Yard Burgers names new CEO

Food services industry vet joins as company restructures

Nashville-based Back Yard Burgers on Wednesday announced the appointment of a David McDougall as chief executive officer.

McDougall (pictured), a veteran food services executive who most recently served as president of FranIntel, Inc., takes over as Back Yard Burgers Inc. is set to emerge from its Chapter 11 bankruptcy. He replaces Jim Boyd, who is the defendant in at least two lawsuits connected to a board-room fight and retaliatory dismissals.

The U.S. Bankruptcy Court for the District of Delaware recently confirmed Back Yard Burgers Inc.'s restructuring plan. The company now has 22 company-owned and 63 franchised locations in 20 states. That's down from about 120 a year ago.

Prior to his tenure at FranIntel, McDougall served as the senior vice president of QSR operations for NexCen Brands Inc., a multi-brand franchise company based in Atlanta. NexCen operated such brands as Marble Slab Creamery, Great American Cookie and Pretzel Maker.

Previous to NexCen, McDougall spent 12 years with Cinnabon in various capacities, including as vice president of operations at FOCUS Brands, a multi-concept franchise company owned by Roark Capital.

He brings the whole package to our brand and we couldn’t be more delighted,” Jim Phillips, Back Yard Burgers Inc. board chairman, said in a release. “As the next chapter unfolds for the company with our emergence from restructuring and our fresh new start, we feel that Dave’s seasoned leadership will be invaluable in returning the Back Yard brand to one of prominence.”
