Local entertainment company sues Martha Stewart

Show producers say celebrity’s TV segment infringes on trademark

A Franklin-based company is suing the media organization of home goods maven Martha Stewart in federal court over an alleged trademark infringement.

Vicki Lea Enterprises owns an entertainment-based trademark for “America's Treasures” — a “continuing news magazine television show.” But the Martha Stewart Show also has a segment called "America's Treasures" and a corresponding column in Martha Stewart Living magazine. The lawsuit claims there could be confusion between the brands because of Martha Stewart Living Omnimedia's actions.

“Consumers are likely to be confused that the goods and services offered for sale, sold and marketed by MSLO using the 'American Treasures' designations are somehow affiliated with, approved or sponsored by Lea Enterprises,” the lawsuit reads.

The suit, filed by Chattanooga attorney Doug Tagtmeyer, asks for a permanent injunction against Martha Stewart Living Omnimedia and for damages related to the infringement.
