Attorneys for Sara Evans ex clash over fees

Former state senator accused of not sticking to settlement deal

Two attorneys who represented country singer Sara Evans' ex-husband Craig Schelske are back in court over a dispute regarding their pay.

Local attorney Larry Crain filed a lawsuit in Davidson County Chancery Court on Monday claiming that he is owed an “attorney's fee lien” from a settlement.

Crain had in 2009 filed a complaint on behalf of Schelske in a defamation lawsuit against Evans' divorce lawyer, Nashville attorney John Hollins Sr. Schelske claimed Hollins made false statements to the press during his messy divorce with the singer.

But while that complaint was pending, Crain learned that Schelske and another attorney, Jeff Miller of Cleveland, Tenn., threatened separate legal action against Hollins and Evans. (Miller is a former state senator who was embroiled in the Tennessee Waltz saga and indicted in 2009 on a number of counts of official misconduct.) At that point, Crain withdrew as Schelske's attorney because he believed the Miller-led litigation was “repugnant or imprudent.”

When Miller took over the case, the lawsuit claims that the parties agreed on providing Crain an attorney's fee lien on any settlement, award or recovery. Schelske and Miller received a settlement from Hollins — but Crain claims he never obtained his fee. (See Crain's complaint here.)

“Mr. Miller willfully disregarded his ethical and legal obligation to hold in his trust account a sufficient portion of the settlement proceeds to resolve Mr. Crain's attorney's fee lien,” the lawsuit reads.

Miller didn't return a call for comment as of Tuesday afternoon.
