Doctor sues former practice over compensation, slander
A Hermitage doctor has filed a complaint against his former practice with allegations of fraud and defamation of character.
The lawsuit, filed yesterday in the Circuit Court of Davidson County, claims that David Livingston was improperly terminated from his practice, following which, he claims, his former partners defamed his character.
In 2006, Livingston joined Family Medical Centers as a partner in the practice. Two years later, according to the complaint, disputes began to arise over compensation with Livingston questioning the amount he was being paid. He alleges that when he approached his partners, he was told to see more patients.
Livingston later changed his address changed from the FMC offices to his home address, because, he claims, the staff was opening his personal mail. The complaint asserts that Livingston was immediately terminated after his partners became aware of the address change.
He further claims that his partners are continuing to collect his accounts receivable without compensating him.
Livingston goes on to accuse other members of the practice of defaming his character following his departure from the practice. In the complaint, Livingston says the other doctors told patients that he had “disappeared,” was “no longer practicing medicine,” and even made allegations of sexual misconduct.
