KiS Golf to liquidate assets
Less than a month after filing for Chapter 11 reorganization in bankruptcy court, Nashville-based KiS Golf Inc. has opted instead to seek a liquidation of its assets. The company submitted a motion on Friday to convert its case to a Chapter 7 bankruptcy.
The motion, available at this link, accuses lenders of causing the failure of KiS by shutting down credit to it in an "unprovoked and ill-reasoned" manner. It discloses that GE Money Bank and Wells Fargo Bank have withheld a total of $330,000 from funds collected in the course of financing purchases made by KiS customers, who committed thousands of dollars each to buy specialized golf club sets that came with "lifetime" access to a golf pro and indoor practice spaces.
Customers throughout the six-state area where KiS operated its mall-based stores have complained that the company used high-pressure sales tactics to induce them to sign contracts that included financing from GE Money Bank and Wells Fargo. The Better Business Bureau has found KiS to have an "unsatisfactory record" of sales practices, and numerous unhappy customers have contacted NashvillePost.com in recent weeks.
The company reports in Friday's filing that GE Money Bank "abruptly terminated" its lending agreement with KiS during a conference call on November 12. The lender took this action "even though the customer dispute rate had dropped dramatically from seven to two percent in the prior six-month period," the motion states.
When the company filed for Chapter 11 protection on November 18, its web site said it would temporarily close four of its 11 stores as part of a restructuring plan. By the end of November, however, all of the units were closed. The web site is no longer available online.
Earlier this month, the bankruptcy trustee's office asked the court either to convert the KiS case to a Chapter 7 or to dismiss it on the grounds that KiS representatives had failed to provide requested information or attend a scheduled meeting about the reorganization attempt.
